The Site is a platform that some businesses (the “Merchants “) use to (a) sell gift cards, (b) sell vouchers for goods, services, or experiences (the ” Vouchers “), (c) sell goods and services directly to you (the ” Merchant Products “), (d) provide coupons, promotional codes, giveaways, samples, and offers Coupons, and (e) sell dining experiences for specific dates and times. The care, quality, and delivery of the goods and services offered are primarily the merchants’ responsibility, sellers, and issuers of the merchant offerings. getEcoupon may distribute vouchers. Additional details regarding the distributor of a certain Voucher are made available upon request. getEcoupon is not a representative of Merchants.

Additionally, the Site offers a platform to buy getEcoupon products (” Products “) and participate in additional activities.

At getEcoupon’s exclusive discretion, certain Merchant Offerings, Products, other offered programs, and pricing on the Site may change at any moment without prior notice.

2. Who owns the website?

We, our affiliates, Merchants, and other content providers own the Site, any content on the Site, and the infrastructure that enables the Site to function. By using the Site and agreeing to these Terms of Use, you are given the following rights and licenses: (a) getEcoupon grants you a limited, personal, nontransferable, nonexclusive, revocable license to access and make personal use of the Site following these Terms of Use and any additional terms and policies set forth by getEcoupon; and (b) you agree not to copy or distribute any information, software, products, or services obtained from or through the Site, nor are you allowed to display publicly or

getEcoupon has the right to refuse service, access to the Site, or an account to anyone at any time and for any reason, in our sole discretion. Although we make a good faith attempt to maintain the Site and your account’s accessibility, occasionally, the Site and/or your account may not be available. You acknowledge and accept that events, access to the Site, or access to your account may be interrupted for reasons both under our control (such as routine maintenance) and beyond our control.

5. Modification

  • knowingly provides information that is false, fraudulent, or inaccurate in connection with your getEcoupon account or to open additional getEcoupon accounts;
  • is not allowed to do anything copyrighted, trademarked, or otherwise protected by a proprietary right without the owner’s prior permission.

any of the following, whether intentionally or unintentionally:

  • violating any restrictions contained in any robot exclusion headers on the website, as well as avoiding or getting around any other security or access control measures in place;
  • combining any offers—current or past—or content—or other information—from the site with content from other sites or on a secondary site without our express written consent (whether through the use of links, other technical means, or physical records associated with purchases made through the site);

9. Clauses of Sale

You accept these Terms of Use, including without limitation the Terms of Sale, by purchasing or getting any Merchant Offering or Product through the Site.

10. Unique Programs

Participating in any of getEcoupon’s special programs, including getEcoupon Reserve, getEcoupon Bucks, the Trade-In Program, Coupons, or getEcoupon+ (Card-Linked) Deals, you consent to these Terms of Use and any extra rules applicable to those particular programs.

11. Trademarks and copyright

The Site’s contents are protected by copyright, trademark, and other intellectual property laws. The Site contains copyrighted material, trademarks, and other proprietary information. This includes but is not limited to text, software, photos, videos, graphics, music, and sound. The content created by getEcoupon itself and the chosen, organized, enhanced, and combined with other content are protected by copyright.

Any content, in whole or in part, may not be modified, distributed, published, transmitted, publicly performed, participated in the transfer or sale, created derivative works, or otherwise exploited. You additionally represent and warrant (or, if you are acting on behalf of the creator of the User Content, you have made sure that the creator represents and warrants) that using and sharing the User Content for the purposes you have chosen won’t violate or infringe any copyrights, trademarks, or other intellectual property rights or rights of third parties, including, without limitation, the rights of publicity or privacy.

You affirm and promise that you won’t upload, post, transmit, or otherwise make available any User Content that is illegal, harmful, tortious, threatening, abusive, harassing, hateful, racist, infringing, pornographic, obscene, violent, misleading, defamatory or libellous, invading another person’s privacy, or infringing on any third parties rights; and that you won’t upload, post, transmit, or otherwise make available any material

Without limitation, getEcoupon shall have the sole and absolute right, but not the obligation, to review, edit, post, refuse to post, remove, monitor, and disclose the User Content and the circumstances surrounding its transmission to any third party, at any time, for any reason, including, without limitation, to determine compliance with these Terms of Use and any operating rules established by getEcoupon, as well as to satisfy any applicable law, regulation, or authorized government body. Grants of licenses.

However, by posting User Content or other content on or through the Site, you grant getEcoupon a royalty-free, perpetual, irrevocable, sublicensable, fully paid-up, non-exclusive, transferable right and license to use, reproduce, adapt, publish, translate, distribute, perform, display, transmit, and sell such User Content alone or in conjunction with other works in any format, media, or technology, whether now known or later developed. You give up any “moral rights” or other claims you may have regarding the authorship of the materials about the User Content under any applicable law or legal theory. 14. Procedures for Reporting Infringements and the Digital Millennium Copyright Act

16. Restrictions on Liability

AS PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL getEcoupon, ITS SUBSIDIARIES OR AFFILIATES OR ANY OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, MERCHANTS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY DIRECT OR INDIRECT LOST PROFITS OR LOST BUSINESS DAMAGES, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF, RELATED TO, OR IN CONNECTION WITH ANY OF THE FOLLOWING: (A) YOUR USE OF THE SITE, THE CONTENT, USER CONTENT, INCLUDING, WITHOUT LIMITATION, ANY PERSONAL INFORMATION, AND ANY OTHER INFORMATION EITHER CONTAINED IN THE SITE OR SUBMITTED BY YOU TO THE SITE; (B) YOUR INABILITY TO USE THE SITE; (C) MODIFICATION OR REMOVAL OF CONTENT SUBMITTED ON THE SITE; (D) THE MERCHANT OFFERINGS, PRODUCTS, AND OTHER AVAILABLE PROGRAMS ACCESSIBLE OR AVAILABLE THROUGH THE SITE; (E) ANY PRODUCTS OR SERVICES PURCHASED OR OBTAINED DIRECTLY FROM A MERCHANT; (F) THESE TERMS OF USE; OR (G) ANY IMPROPER USE OF INFORMATION YOU PROVIDE TO THE SITE, INCLUDING, WITHOUT LIMITATION, ANY PERSONAL INFORMATION. IN NO EVENT WILL getEcoupon’S LIABILITY IN CONNECTION WITH A MERCHANT OFFERING, PRODUCT, AND OTHER AVAILABLE PROGRAMS EXCEED THE AMOUNTS PAID FOR THE APPLICABLE VOUCHER, PRODUCT, OR SERVICE.
